- Open Question: Can an occupant of an apartment be charged with a broken lease on their credit?
I was living with my brother and the apartment was in his name. At the signing of the first lease I was only 17 and never submitted employer information. The last time we renewed the lease I was 19 but never filled out an application or submitted employer information. My brother decided to jet and didn't want to pay rent anymore so I left too. Now there is a potentially harmful statelment on my credit report from the apartments. So now I am trying to rent my own apartment and that is preventing me from moving on with my life. So I need to know how to dispute this please help me!!
- Open Question: i need to know 2 things. can this affect me legally? can this affect my credit score?
I have a cousin that applied for a loan on some website with a bank outta california. i did not know it, but he used my name as a reference. i never signed anything, and i was not a co-signer on it. my cousin ended up defaulting on the loan. now the bank has hired a lawyer of some sort to get their money back. or something. he contines to call my house and threaten me with legal action if i don't call him back and cooperate with him. he just called again today and now says if i don't call him back, he will send a report to the credit bureaus and it will affect my credit. i just need to know if i have any legal responsabilities to this matter? is it possible that he can attack my credit? can i retaliate and turn this into a harrasment case against the lawyer?
- Open Question: why my husband health insurance company need my social security number to be his beneficiary?
I was victim of identify theft a few years ago even though I report it to the police and FBI my credit got ruined and for years I kept getting phone calls from collections ffices . I changed my number and address to avoid everything . Anyway I just got married and my husband want to include me in his health insurance because I cant get insurance through my employer without paying $400 a month . when I got the documents I noticed that they need all my information including my social security number . I dont mind giving all my information but Im afraid to give my social security number because I think Im going to start getting phone calls again from collections offices and honestly I cant deal with that anymore I already went through a lot of frustration and getting 5 to 10 calls a day and as you all know they dont listen when you want explain what happen . so my question is is it safe to give my ss# to the health insurance company?

- Open Question: 401k transfer of funds tax advice?
So I have a unique issue and my bank said I should consult a tax professional for which I plan on doing probably no matter what I get as an answer to this question. But I asked the question as to where I should get tax advice for it and everybody wanted more detail to solve it so I'll give it a shot. I had a 401 for a previous employer with like 10k in it. When I left that company the bank rolled it over into an ira. A year later I decided I should take the money and roll it into what was my current employers 401k plan. So I filled out the necessary paperwork with the bank and they sent me a check to give to the holder of what was my current 401k. This happened in December 2009. Well I never ended up giving the check to what was my current employer as I got fairly busy and ended up switching jobs again. At the current time I wish to take the money out as cash to pay off my credit card bill which has gotten rather high during this bit of transition. Thing is the Bank closed the IRA when I asked for the check in 2009 and reported it to the IRS even though it was never cashed. They said I could fill out paperwork open another IRA with the money then cash it out. They told me they think that I should have filed this on my 2009 returns but I did no such thing since the money didn't change hands from my perspective in 2009 I just received a check that was never given to anyone so no money changed hands, not to mention I wasn't going to attempt to cash it then just roll it over so there wouldn't have been any changes in income even if cashed. Anyway the question is do I have to file an amended return for 2009 stating that that account was closed? If not, I should be good to open up the new IRA with the same money then cash it out and file it on my 2010 return I think. ok... I'm ok with the penalty... But the check is no longer good and the bank is telling me I need to open another account to get the money. So if I open another account then cash it out does that count as withdrawing the income twice? I'm ok with having to file an amended return as long as I get the money. also my conversation with the bank said that the 60 day rollover rules does not apply to direct rollovers or direct transfers

- Open Question: should I pay my bills, not pay, or settle?
I'm a 24 year old california resident. My father started a credit profile on my social security when i was 13 on a fake name. I caught him when checking my credit report. He paid all the debt off, but what I had left was an extremely good credit score when i was 18. i applied and applied for credit cards when i became 18 to collect airline miles. i collected nearly 800,000 airline miles through that and I did some amazing travelling. i had a good income coming in, but then my business crashed but slightly recovered, however, my girlfriend is a shopaholic, and I kept buying her stuff. i bought five new cars in my life. i'm 24. i just graduated college. i have $168,000 in debt. I have an income of about $7500 per month after taxes which is really good, but most of my money is going to debts, and I have to live at home with parents and have an ok living. I look at my minimum payment warnings, and they say it will take 32 years to pay off. I have three options. Option 1 is to not pay. Being self employed, I have the ability to dodge collectors and court actions especially since I can go to another country. I meet the requirements to get permanent residency at Spain, UK, or Canada. I can make the same amount of money anywhere. I can probably even stay here in California, and get away since I have foreign bank accounts. My other option is to settle my debts, but I don't know what amount card companies will settle for. My other option is to keep paying the debts on time, but it will take 32 years to pay off. I can also do bankruptcy, but given statue of limitations, and the ability to not pay bills, I rather just hide than to declare bankruptcy publically. I'm also worried that my parents will find out about this. How do I explain 168,000 dollar debt? - What if they ask me to do something that requires me to run my credit. All I can do is put a freeze on my credit report so nobody can check. I also can rent an apt right now with the good credit I have and stay in it until my credit recovers. I see no reason for moving in the future. I'm young, and I'm sure I can stay in an apt until my credit recovers which can take up to seven years.Sometimes, I'm worried about my parents finding out, and I want to commit suicide. i have no morals. atheist. i believe in helping others so i can benefit back myself in some way. i don't do it for the goodness of my heart cuz i don't believe in it.
- Open Question: What happens next after filing Identity Theft Police report?
My ex and I separated two years ago. We sold our home and moved our separate ways. What I didnt know (until recently) was that she kept the phone/cable account and just trasferred it/rolled it over to her new home. I find this out because now collections is calling ME asking for the $500+ that was not paid a couple months ago from her residence but since it's still in my name, even at her address, they are after me and it's messing up my good credit. To say the least, I am furious and the ex wont contact/respond to me regarding it. The phone/cable company said they can remove my name and put her name on it IF I can show proof that we separated, no longer together, etc... and I have to file a Police Report for Identity Theft. Well I have all the required info ready except I havent gone to the police station to file the identify theft report. What does this entail? After I file this report what do the police do?? Is it just held for records or do they pursue further? While I want my credit fixed, I really dont want to take my ex to court over all of this either, unless there is no other option. I just wanted to know what happens after I file the paperwork with the police. Thanks
