Questions on Credit Report Disputes

  • Open Question: Can a collections mark from a US Cellular be removed from my credit report?

Due to mismanaging a bill I went from a 750 credit score down to 635. (US Cellular) This is the only negative mark on my credit report and 1 yr later I am still under 700. I tried to dispute it w/ the credit agencies, but they closed the dispute due to it being paid off. What are my chances of having this erased/removed? Is there anything specific that I should mention in my request of reversal? I've written the cell company requesting it be removed but no response. Trying to refinance my home and because of this I am missing out on the opportunity of getting good rates. I really want this item removed.

  • Resolved Question: 6 years old bad credit questions..?

My husband has a 6 years old bad debt from a CC company. It was write off but still in his credit report. We check his credit report as we wanted to get a home loan through VA. But a few days after, a guy from collection agency calls and wants to collect money from an old debt which they can't even verify. Then, they sent us a collection letter, offering us a monthly installment. But even though we wanted to pay, they charges $2,500 from an original $300 credit limit, that's ridiculous. My husband said he didn't owe that much! What's the best option for us now? I check and this debt is long past the SOL. I constructed a letter to dispute and for them to stop calling and to give us details of the said debt, but saying "Please be advised that this is not a refusal to pay" doesn't reset the SOL? We wanted to pay the debt, but not the amount they ask us. You think it's better for us to just made an offer or dispute the said debt? please anyone.. I read somewhere that once the debt is sold to a collection agency or the original creditor writes off and transfer the debt to CA, you can no longer contact the original creditor. Is this right? • Open Question: Can you get into trouble for disputing information?

If you dispute unflattering information in your credit report that may be accurate, will there be legal ramifications? I am getting ready to house shop and I was told that your credit report is like a traffic ticket, you should always fight it, but I was wondering if there are legal consequences to disputing information on your credit report. There is a lot of information that I just dont remember.

  • Open Question: Credit report dispute, how long?

I recently disputed several inaccuracies on my credit report. How long do the creditors/agencies have to respond? Also, if they do not respond in the allotted time, will the inaccuracies automatically be removed? The thing is, my report says that my student loans/car loan were included in my bankruptcy and the weren't. Student loans cannot be discharged, and I reaffirmed my car note. One of the reports is not even reporting my car note at all. Since my loans are reported as part of my bankruptcy, my on time monthly payments are not reported. I can't imagine that there would be a problem having them corrected, can you?

  • Open Question: european rental car insurance: how to avoid paying deductible?

I rented a car in a trip to Germany, there was a 750 euros deductible. Then I've been in an accident, with no my fault (have a police report), second party escaped the scene. There was a damage to a car, and now rental company unable to get money from the second party, "asking permission" to charge my credit card for those 750 euros, or send them a check. They already have my card number and address, and as far as I could recall -- even my signature on a contract, which I think authorizes them to charge this deductible, but they still asks. Is there an option to insist I don't want to pay as the accident wasn't my fault? And if they'll anyway charge the card, will it help to open a dispute with the credit card company?

  • Resolved Question: Reasons to dispute a delinquent account on a credit report?

Can you dispute a delinquent account on your credit report if you believed the account was closed and the company never contacted your via mail or phone? I had an account open with Bally Fitness that had $200 on it and I had every reason to believe it had been closed. I had called them, sent them a document (which yesterday I was told had not been received), not used the club in 8 months and was not made contact with. I have agreed to pay them the sum since I am not looking to mess them around. However, If they do not agree to remove the delinquent record from my report, can I dispute it based on the fact I was never informed in any way whatsoever? Thank you Prove it or lose it, I read the FCRA and it appears that I do have something legitimate there. I was never contacted by them about the account being open or the information going on my report. That does appears to violate the FCRA. Does anyone have any more information? I shall be calling their corporate office monday morning. Thanks for all the input. I am not so sure this went to a collection agency as the account was still open with Bally. If it went to a collection agency then I would imagine that they would have made an attempt to contact me about the money, right? I read the report and it appears to state that a party has an obligation to make contact in writing, via phone or electronically and I received none of these. I am sure it will be difficult and I might have no ground to stand on, but I have to try and I honestly feel I have grounds for contest here.
